3. Products & “As Is” Disclaimer

We specialize in the retail of electronic gadgets including, but not limited to, Powerbanks, Earbuds, Neckbands, Projectors, Smartwatches, and Wired Headphones. While we strive for accuracy in our product listings, we do not warrant that product descriptions, colors, or other content are error-free.

  • No Warranty / No Guarantee: To provide you with the lowest possible prices, you explicitly acknowledge and agree that all products sold on Xome Store India are provided on an “AS IS” and “AS AVAILABLE” basis.
  • We do not provide any extended warranty or guarantee regarding the longevity, durability, or performance of the electronic items once the initial 7-day refund window has expired. You assume the risk of the product’s performance after this period.

4. Pricing, Payments & Offers

Pricing: All prices listed on the website are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise. We reserve the right to modify prices at any time without prior notice.

Payment Methods: We operate a 100% prepaid model to ensure logistics efficiency. We do not offer Cash on Delivery (COD). You must effect payment via the secure online payment gateways provided on the website.

Time-Bound Offers: Any discounts, coupons, or flash sales published on our social media are strictly time-bound. We reserve the right to revoke any offer at our sole discretion without prior notice.

5. Third-Party Marketplaces (JioMart)

We actively sell our inventory on third-party platforms, specifically JioMart. It is crucial to understand the distinction in jurisdiction:

  • Separate Jurisdiction: If you purchased a product listed by Xome Store India via JioMart, your transaction is governed entirely by JioMart’s Terms of Service, not ours.
  • Dispute Resolution: Any return requests or refund claims for JioMart orders must be directed to JioMart Customer Support. We cannot process refunds for orders not generated directly on www.xomestore.com.

6. User Conduct & Prohibited Uses

You agree to use the site only for lawful purposes. You are strictly prohibited from using the site: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to infringe upon our intellectual property rights; (d) to submit false or misleading information; or (e) to upload viruses or malicious code that may affect the functionality of the Service.

7. Limitation of Liability

In no case shall Digital Marketing, our partners, officers, employees, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from your use of any of the service or any products procured using the service.

8. Indemnification

You agree to indemnify, defend and hold harmless Digital Marketing (Xome Store India) and our affiliates, partners, officers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.

9. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India. The courts in New Delhi, Delhi shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, shall be referred to an independent arbitrator who will be appointed by Digital Marketing.
